>> good morning. i'm scott mcgrew. it's 4:30. let's get to a forecast and meteorologist christina loren. good morning. >> good morning to you, scott mcgrew. well, we've got an interesting setup for today. temperatures are not going to be all that much warmer than where we ended up yesterday. and this cold dreary pattern continues all the way through the weekend and the beginning of next week. temperatures 15 degrees below their averages. i'll let you know when we're going to warm up. i'm picking up significant warming trends as we see high pressure build in at the end of next week. and boy, when it builds it's going to get hot fast. your full forecast in moments. there's always something happening on the roads at this hour. >> good morning. that's because we've got somebody on the roads. right now we're looking at the south bay. good number of roads to pick from. so far no major incidents.

a disabled vehicle around stevens creek. and this construction on highway 87. that goes on through noon. watch for slowing. one lane is blocked but nothing major because there are so few cars. around noon closures around, music in the park today, scott, the format is power pop. i don't know what that is but there is a concert there. >> fair enough. new this morning we may learn more about the fatal officer-involved shooting on a b.a.r.t. platform. christie smith is live in oakland where the b.a.r.t. board is going to meet about the shooting at the civic center station. good morning. >> reporter: good morning. i went on line to b.a.r.t.'s website, coming out 11 days after that shooting at civic center b.a.r.t. in san francisco. this comes as b.a.r.t. is also promising zero tolerance for future ptests like the one that followed the shooting on

monday. and caused significant delays during monday's evening commute. nearly 100 protesters stormed the b.a.r.t. station blocking doors and forcing a temporary shutdown of the station and impacting other stations. this was in response to the fatal b.a.r.t. police shooting of transient charles hill. according to b.a.r.t.'s chief hill attacked the officer with knives and a bottle. the group came together following the shooting death of unarmed oscar grant by then bart police officer johannas mehserle. they want the b.a.r.t. police force disbanded but b.a.r.t. says for its part it's going to take extra steps to make sure that protesters will not be able to disrupt service again but they won't be specific about what they are going to do because they feel the protesters will change tactics. b.a.r.t. police did not arrest any one on monday and the b.a.r.t. agenda has public

comments. reporting live, christie smith, "today in the bay." >> thank you. also this morning a mysterious death in the south bay. investigators trying to figure out how a man died after a fisherman found his body in the waters of a creek near a golf course. the crews pulled the body out late last night. the man fishing in the area spotted the man's body around 5:00 last night. police say it could take days to figure out who the man was and how he died. >> also this morning a bay area teenage ser in critical condition after she was swept out to sea. she was rescued in tennessee cove north of the golden gate bridge lat night. the coast guard tells us the 17-year-old and two friends got stuck in heavy current out on the point just as the tide was coming in. rescuers say a number of hikers rushed from the cliffs above to help. >> i just saw a lot of people hesitating and not knowing what to do but as soon as she came

close enough i ran in the water, grabbed her and then a wave came and hit us, and i was still holding onto her and i was trying to make sure me and her did not go in. >> rescuers had to dive in after one bystander who swam out to try to save the teens also had trouble. officers say the three teens were trying to get to a secluded cove when they were knocked over by a wave. the current pushed a boy and girl to shore, the other girl you can see air lifted. this afternoon a decision in the devastating pit bull mauling case that killed a toddler, put his grandfather in jail. today a judge will we side if he will send the 53-year-old to trial. three of his pit bulls mauled his 2-year-old step-grandson to death in concord when the toddler wandered out to the garage where the dogs were kept. the district attorney wants to charge with second-degree murder

because he knew the dogs were dangerous. we were the first station to interview the the grandfather a year ago. he told us at the time he knew at least one of the dogs was aggressive. >> the girlfriend of giovanni ramirez sin jail in las vegas on meth possession. ramirez has been accused in the beating of giants fan bryan stow though never charged. denise pleaded not guilty. her boyfriend ramirez is in jail, there you see him, on a parole violation. >> stow's parents are on a long list of creditors in the dodgers' bankruptcy case. the team tells the courts it's possible that the dodgers will owe them money in the future. the stows sued the dodgers on their son's behalf. stow remains in sf general in serious condition after he was beaten at dodger stadium march 31. a somber celebration for cal grads still behind bars in iran

700 days after their arrest. shane bauer turned 29 yesterday in iran where he remains in prison with his friend josh fattal. last night loved ones including bauer's fiancee gathered for a celebration of sorts. iranian soldiers arrested the two along the iraq and iran border accusing them of spying. >> we're hoping that this is going to be the end of our nightmare and shane and josh will come home. we don't feel we can be more devastated than we already are but on days like this it brings it home. >> bauer and fattal are saided july 21. san francisco mayor ed lee will set fwrat reopening of affordable housing apartments in the tenderloin this morning, that's a bright spot for a neighborhood seeing an uptic in

crime. police report shows the crime rate on the first block of turk street is 17 times higher than the entire rest of the city. stats that the director of the tenderloin housing clinic says should be unacceptable to city leaders. >> we can't get people to move into this area and fill in vacant store fronts unless this area is no longer allowed to continue as an open air drug supermarket. >> joe's restaurant owner says small businesses and nonprofits need to believe in the area and people need to have the guts to open businesses in the tenderloin. >> today tuition costs could soar higher for uc students. the board of regents will vote in san francisco today on a plan to hike tuition by nearly 10%. that's in addition to an 8% fee hike already in place for this fall. the two fee hikes combined would bring undergrad tuition to $12,200 a year. $1900 more than last year. the vote comes days after csu

trustees bumped tuition up 12%. >> we're back to meteorologist christina loren as she looks at the weekend. >> good morning to you. hey, we still got a couple of business days to get through, mr. mcgrew. you're like me thinking about the weekend. if you want to do outdoor activity this is weekend especially inland weather will be nice. it won't be too hot. you can continue to give your ac a break. we have an interesting setup. that area of low pressure that kept on shore flow in place, finally it's pushed inland. but we have another one on its heels that's going to increase the on shore flow. the difference out there is the marine layer's not quite as deep so we have breaks in the clouds. you can see that full moon in some spots especially in the south and the east bay. throughout the day today, temperatures aren't going to climb that much. 56 now in livermore, you're on the way to about 62 at noon, that's it. then we're going to round out at 4:00 p.m. with temperatures in the 70s again, i think santa

rosa and san francisco warmer because we're going to see the sun come through. a little bit earlier than yesterday. it was socked in the city almost all day. 70 degrees, that's what you can expect in san jose. 73 in gilroy. 71 in los gatos. stay tuned. the seven-day outlook. what's to come for the weekend, that's on the way. let's get you on your way to work with mike. >> we're looking a bit north of the last report, this is out of the south bay, northbound 280 around el monte. got word that it sounds like a deer has been killed on the northbound lanes. sounds like the slow lane is blocked. we do see some sudden slowing from 85 up to the scene. that's extensive for a report of this. we're sorry for the loss of the animal. so far no people injured. we have the slowing, we're following and that should clear up over the next few minutes. i'll follow that and the construction on 101 past university. might see flashing lights as you approach the crossover toward the dumbarton bridge.

for the north from there the san mateo bridge moves nicely. there is drizzle in parts of the bay area but the view is much clearer. you can make the lights out on the high rise. that's a good crossing right now. we'll watch as it gets more crowded. >> all right, mike. coming up the man suspected of stealing a picasso from san francisco wanted in another brazen heist. and no charges filed against the airline passenger who wore saggy pants on a plane. why is the legal drama only just beginning? 4:41.

>> if you are just waking up, good morning. it's 4:44. we look inside the control room. the wine expert in jail for allegedly stealing a picasso from san francisco art galleries also wanted for stealing fancy wine back in april. the new jersey journal report there is is a warrant out for mark lugo for stealing three bottles of expensive wine from a store in new jersey. how expensive? each bottle worth $2,000. police in the bay area arrested lugo last week after surveillance video appeared to show a man matching his description, walking away with a picasso from a san francisco art

gallery tucked there under his arm. he's pleaded not guilty in the art heist case. >> the college football player arrested after wearing saggy pants on a plane says he plans to sue. the examiner reports deshon mar mon's correspondents want u.s. airways to reimburse him for the $500 of flight he missed. marman charged with battery on a police officer after he allegedly refused orders from the flight crew to pull up his saggy pants while boarding a flight. the district attorney decided not to press charges. >> it's the world against apple this morning. for more on that and news before the bell let's turn to nicole lapin. good morning. >> hey, good morning, scott. futures turned higher after they were sitting in the red for most of last night. that of course after a major ratings agency moody's warned that it may cut the u.s. credit rating because of the rising

risk of a government default. the u.s. has reached the borrowing limit. they did that back in may and could run out of cash to pay bills starting august 2. if congress doesn't raise the debt ceiling. that would put rates up on treasury bonds and mortgages and other loans linked to treasuries. asian markets were cautious. europe is higher. we get a ton of data out so that could drive the way we trade. yesterday, though we narrowed some losses closing down 44 points, 12,491 is where we closed. the nasdaq added 15 to 2796. amazon is taking on apple. reports say the on line retailer will unveil a tablet device. the tablet has a 9 inch screen. no price has been made available just yet. as of today you have another on

that might not be the case through the next couple of hours. we expect a pretty significant marine push. in the east and the south bay you can see that glorious moon overhead. the biggest difference we'll notice today, not as much fog, not as deep of a marine layer. i think places at the immediate coast will get warmer, otherwise looking at about the same. where we ended up yesterday. this is where we are now. 54 in san mateo, 50 up in santa rosa, you'll probably dip to the 40s, santa rosa, even napa before we hit our lows. those register right before sunrise. in about 45 minutes. 62 degrees in livermore, 66 in san jose as you break for lunch. no need for the heavy jacket, no need for the tank top. we're dressing as if it were late october. that's where our temperatures are averaging this time of year, about 15 degrees below our seasonal averages in the middle of july. if you're enjoying it we've got

>> welcome back. it's 4:52. there is the bay bridge and more clouds. it has been a strange shot of the bay bridge the last couple weeks. this morning the reward is growing to track down a man who killed a chilean national in the east bay. berkeley police say the chilean government boosted the reward fund to $20,000. the man had just moved to berkeley to be with his fiancee when he was shot during a robbery attempt near the ashby b.a.r.t. station in september. he was rushed to the hospital where he later died on his 35th birthday. >> an update to a story we brought you yesterday. a south bay neighborhood grieving the death of a 22-year-old man swept to sea in

hawaii. paul was climbing a rocky cliff on the eastern side of the big island when a wave crashed into him and carried him out the sea. crews found him face down 100 yards out. he later died at hospital. his friends in sunnyvale say he was looking forward to a trip to hawaii and couldn't believe he's gone. >> my heart just sank. for to the happen. for to the happen to him. he was the best kid you could possibly -- >> he is the second bay area man to die in hawaii in two days. saturday 44-year-old david pots died when a wave washed him into a blow hole on maui. his family is expected back in the bay area from hawaii today. >> let's check in now with laura, a preview of some of the other stories we're working on. >> good morning. we're following the arrest of the girlfriend of the prime

side. there is a 30 by 30 sinkhole here, from our initial reports, in the slow lanes. that's going to close the off ramp until about noon. we have live pictures. we can make out flashy lights. i see the flashing lights in the middle of the screen. you see how light the volume is. >> and we're talking about on the actual exit ramp, not on the highway. >> actually the slow lane of the highway is closed from what i understand, the off ramp. >> to prevent people. and the sinkhole. >> that's huge. you can see it's not a major traffic issue but as the sun comes up we'll get more. bob is saiding out there. we'll get clarification. this could be a major issue. this could have a big impact. >> mike, thank you. finally the bearded one wearing a spandex outfit that would make a tour de france cyclist blush.
